Any worker who has not been paid wages, allowances or severance pay. You can file even if you have no status (undocumented workers too).
An agent cannot do this one for you. You have to go to the office below yourself.The local labor office of the Ministry of Employment and Labor (고용노동부 지방고용노동관서); you can also file online on the Labor Portal (노동포털). For the substitute payment (대지급금), the Korea Workers' Compensation and Welfare Service (근로복지공단)
🔴 The right to claim wages expires after 3 years, so if you put it off you lose it. If the company has no money to pay, you can get a confirmation of unpaid wages from the labor office and claim substitute payment from the Korea Workers' Compensation and Welfare Service (the body that runs industrial accident insurance). This is a labor law case, so it belongs to certified labor attorneys and lawyers; free counseling is on 1350 at the Ministry of Employment and Labor (multilingual) and at foreign worker support centers.

- Complaint form (진정서) for unpaid wages
- Labor contract, or proof that you actually worked (attendance records, text messages, photos)
- Pay slips and bank account transaction records
- Workplace details (business name, address, representative)
- Copies of your passport and Alien Registration Card (외국인등록증)
